Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of manufacturerscollective.com (the “Site”), operated by The Manufacturers' Collective (“TMC,” “we,” “us,” or “our”). By accessing or using the Site, completing the Self-Assessment, or booking a Discovery Call, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Description of Services
TMC provides advisory services to owners of family-owned American manufacturing companies navigating generational succession. The Site offers informational content, a self-assessment tool, our book Sustaining a Family Jewel, and a means to schedule a complimentary Discovery Call with Davis Anderson. Any formal advisory engagement beyond the Discovery Call is governed by a separate written agreement between you and TMC, not by these Terms.
No Legal, Financial, or Investment Advice
The Site, the Self-Assessment, our book, and any general content provided are for informational purposes only and do not constitute legal, tax, financial, investment, or accounting advice. Nothing on the Site creates an advisory, fiduciary, or client relationship between you and TMC.
Succession planning decisions have significant legal, tax, and financial consequences specific to your business and family. You should consult qualified attorneys, accountants, and financial advisors before making decisions based on anything contained on the Site.
The Self-Assessment
The Generational Succession Self-Assessment is a general, educational tool intended to help you reflect on your family business's succession readiness. Your responses and any observations Davis provides in reply are not a comprehensive evaluation of your business, and should not be relied upon as a substitute for a full engagement or professional analysis.
Intellectual Property
All content on the Site — including text, graphics, logos, the TMC name and marks, the book Sustaining a Family Jewel, and the Self-Assessment questions and framework — is owned by TMC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and share content for personal, non-commercial reference, but you may not reproduce, distribute, or create derivative works from it without our prior written consent.
Acceptable Use
When using the Site, you agree not to:
- Submit false, misleading, or fraudulent information;
- Interfere with or disrupt the Site's operation or security;
- Attempt to access data or systems not intended for you; or
- Use the Site for any unlawful purpose or in violation of any applicable law.
Third-Party Services & Links
The Site links to and integrates with third-party services, including Calendly for scheduling Discovery Calls and LinkedIn for social content. These third parties operate under their own terms and privacy policies, which we do not control. Your use of any third-party service is at your own risk and subject to that provider's terms.
Disclaimer of Warranties
The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any outcome will result from use of the Self-Assessment or general content.
Limitation of Liability
To the fullest extent permitted by law, TMC and its owners, officers, and representatives will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from or related to your use of the Site, the Self-Assessment, or any content, even if advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold TMC harmless from any claims, losses, or damages, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site.
Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Illinois.
Changes to These Terms
We may revise these Terms from time to time. The “Last updated” date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
